In accordance with Article 13 (1)-(2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 regarding the protection of natural persons with regard to the processing of personal data and on the free flow of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the „GDPR"),we would like to inform you that:

Personal data processed

In this clause, the Administrator – ZPSO ROSA Sp. z o.o. inform about all forms of use of personal data in relation to natural persons who are:

suppliers, sales representatives or contractors of ZPSO ROSA Sp. z o.o. ,
subcontractors of suppliers or contractors of ZPSO ROSA Sp. z o.o. ,
partners, employees, statutory representatives, proxies, representatives of suppliers, sales representatives, contractors or their subcontractors,
other persons whose data we process for the purpose of issuing or implementing invoices as part of cooperation with suppliers, sales representatives or contractors.

Categories and purpose of personal data processing

The processed categories of your personal data are data that are closely related to the cooperation, including commercial cooperation, between you and ZPSO ROSA Sp. z o.o. , in particular:

name and surname, company, business address and correspondence addresses,
numbers held in the relevant registers (e.g. NIP or REGON number, PESEL number),
contact details, such as e-mail address or telephone or fax number,
the position you hold within your organization or function,
experience or qualifications,
bank account number.

In the case of concluding a contract directly between you and ZPSO ROSA Sp. z o.o. , providing the data specified above is voluntary, but necessary for the purposes of concluding the contract and then performing it.

The recipient of your personal data are employees and associates as well as partners supporting ZPSO ROSA Sp. z o.o. in his business activities.

We may obtain your personal data from publicly available sources, such as CEIDG or KRS business registers to verify the information you provide. The scope of the data processed will in this case be limited to the data publicly available in the relevant registers.

We may also obtain your personal data from entities in which you are employed or represented. The scope of processed data will include in this case information necessary to handle cooperation and contact with the Contractor, e.g. information about the change of contact details.

Basics to personal data processing

The legal basis for the processing of your personal data is Article 6(1)(b) or (c) or (f) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data on the free movement of such data and repealing Directive 95/46/EC, which means that we process personal data only if, when:

the processing is necessary for the fulfilment of contractual obligations or for undertaking certain pre-contractual measures, e.g. preparation of a draft contract (Article 6(1)(.b GDPR);
processing is necessary in order to comply with the legal obligations of ZPSO Rosa Sp. z o.o. or it is directly required by law (Article 6(1)(.c) of the GDPR) – in the scope of personal data contained in documents subject to archiving on the basis of legal provisions;
processing is necessary for the implementation of the legitimate interests of ZPSO ROSA Sp. z o.o. or a third party and does not unduly affect your interests or fundamental rights and freedoms (Article 6(1)(f) of the GDPR). Such legitimate interests are:

i. contact with Contractors and handling of a given contract;

ii. prevention of fraud and criminal activity;

iii. determination or investigation by ZPSO ROSA Sp. z o.o. civil law claims in the course of business, as well as defense against such claims;

iv. verification of Contractors in public registers

Personal data receivers

We may transfer your personal data to other recipients. Such recipients are entities processing personal data on behalf of ZPSO ROSA Sp. z o.o. , such as:

entities insuring transactions with an extended payment term,
financial institutions involved in the process of performance and settlement of the contract;
courier or postal service providers;
entities conducting advisory activities, entities conducting audit activities and law firms;
authorized institutions or bodies - in the scope of their statutory activities, such as: Police, Court, Prosecutor's Office, Municipal Guard.

Personal data will not be transferred to third countries or an international organization.

Your personal data is not subject to automated decision-making, including profiling.

Your rights

Any person whose data is processed by ZPSO ROSA Sp. z o.o. , has the right to:

• request from the administrator access to his personal data and obtain a copy thereof, rectify them, delete them or limit processing;

• object to the processing;

• data portability;

• lodge a complaint with the authority.

The period of personal data storage

Your personal data will be processed until the time of withdrawal of consent or if the data will be processed on the basis of the legitimate purpose of the administrator – until the objection is raised.
Personal data is processed only for the specified purpose and to the extent necessary to achieve it and for as long as it is necessary.
Below are listed the basic goals pursued by ZPSO ROSA Sp. z o.o. through the processing of personal data and the periods for which it processes them:

Fulfillment of contractual obligations - Duration of the contract between the Contractor and ZPSO ROSA Sp. z o.o.;
Storage of documentation for the purpose of demonstrating compliance with obligations arising from the provisions of law, in particular the Accounting Act and the Act - Tax Ordinance - Period indicated in the relevant provisions of law - as a rule, these are 5-year periods;
determination or investigation by ZPSO ROSA Sp. z o.o. civil law claims as part of the conducted business, as well as defense against such claims – for appropriate periods of limitation of such claims, i.e. as a rule, no longer than for 6 years from the occurrence of the event resulting in the occurrence of the claim.
